12-year-old charged with capital murder in baby's death What exactly is meant by "blunt force trauma to the head"? What story did the boy tell about what happened? What is his history? If he's been known as patient and good with kids, it would be different than if he's a thug. Is the charge based on a medical "diagnosis" of murder (doctors saying that the baby had certain symptoms and the ONLY thing that can cause those symptoms is abuse and the ONLY person who could have caused them is the person with the child at the time of collapse). Sometimes "blunt force trauma to the head" means pretty much the same thing as "shaken baby syndrome", in which doctors diagnose not only THAT a crime was committed, but WHAT the crime was, WHEN it was committed, WHO committed it and the state of mind of that person. If that is the basis of the charge, no one, of any age, should be charged. It is known that SBS symptoms can be caused by other (rare) congenital diseases. Were TESTS done to rule them out? There may be as-yet-unknown natural causes. There are confirmed cases of babies falling and dying. There are confirmed cases of babies being abused but not collapsing for 16+ hours. My first impression is that charging a 12-year-old with capital murder on circumstantial or "expert" evidence is itself child abuse. If the whole thing is on videotape (proven beyond any doubt), I might have a different opinion. There really isn't enough information in the article to know how much doubt there is as to what happened. I do not think doctors should EVER be allowed to "diagnose" legal conclusions, for people of ANY age. There is a lot doctors don't know about infant brains. An 11-month-old child is fairly large. How large and strong is the 12-year-old? Way too many questions to be able to give an informed opinion. Susan Weston 99511


No a 12 year old should not be charged with capital murder, you are suppose to be innocent until PROVEN guilty and that is something Harris county has gotten away from they believe the first thing that there here and they should do the right thing. we are suppose to be able to trust those in law enforcement but these days you better not trust anyone but God he is the only one who really has your back. Parents please let this be an example to you take your children with you or get an responsible adult to stay with them. Your children are your responsibility and when we act as unresponsible parents we allow things like this to go wrong.Children are precious jewels and we need to protect they in that way.
